1. In my opinion, at the time Mary was discharged she was being treated by Little Lamb Company as an employee rather than as an independent contractor. Sole of the factors that led to this determination include the fact that her work was being done under close supervision and direction. Another significant factor was the fact that the company required Mary to use company material and equipment. The fact that Mary was required to adhere to company work schedules suggests that she was also being instructed to perform the work exclusively at Little Lamb's place of business. Also, the fact that Mary has worked at the same company for almost two years suggests an employee-employer relationship more than it does the less frequent or shorter duration relationship between a company and its independent contractor.
