This research considers the product liability risks which may be encountered by a corporation engaged in the production and marketing of an over the counter analgesic for headaches and general bodily pain. The hypothetical firm is the Angleton Company, and the hypothetical product is Pax, which is produced only in tablet form.

In one sense, risk is considered to be a measure of uncertainty. In this broad context, everything that is done by a private sector organization involves risk. The concept of risk is narrowed somewhat by the definition holding that risk is the possibility of an adverse outcome to an event. This definition, too, however, is somewhat broad. Within the context of this research, risk must be defined as the possibility of an adverse outcome to an event, wherein there is also the possibility of a real and recognizable loss to the company.

Corporate risks associated the production and marketing of products exist with respect to both general liability and product liability. General liability risks are those associated with in which another is injured, becomes ill, suffers pain or discomfort, or suffers a loss as a consequence of some action under the control of the organization. The media and the company's competitors are in the unique situation of being able to influence company response decisions through actions of their own. The business community generally, and trade associations will suffer, if company responses are either inappropriate or inadequate. Educational institutions, intellectuals, and the clergy are stakeholders, because they are in a position to influence public opinion toward an affected company. Courts of law are stakeholders because they will almost certainly become involved in a product liability case, and because company responses will directly affect their own actions. Customers are possibly the most important stakeholder group of all. First, they are most directly affected by product safety, and second, it is their unified action which will ultimately spell success or failure for the company's response strategy.
