HR 311-Civil Rights Amend. Homosexuality

On January 6, 1999, House Representative Edolphus Towns introduced Bill H. R. 311 before the 106th Congress. H. R. 311 is a bill that was fashioned to “amend the Civil Rights Act of 1964 and the Fair Housing Act to prohibit discrimination on the basis of affectional or sexual orientation, and for other purposes” (H. R. 311: 1). The short title for the proposed Act is the Civil Rights Amendments Act of 1999. This Bill is designed to extend civil rights to include affectional or sexual orientation in the areas of public accommodations, public facilities, federally assisted programs, housing and equal employment. The Bill defines affectional or sexual orientation to mean, “male or female homosexuality, heterosexuality, and bisexuality by orientation or practice, by and between consenting adults” (H. R. 311: 2).

This Bill is designed to afford Civil Rights protection for primarily homosexual Americans, but, it is also a step closer to changing the perception of many Americans and legislators that homosexual rights are not the rights of some special interest but rather Civil Rights. The Clinton and Gore administration has in this area has been progressive but unsteady. Nonetheless, both the President and Vice-President have championed Civil Rights that include all Americans and are viewed as Human Rights, not those of some particular minority or special interest. Discrimination against sexual orientation in the workplace deprives homosexuals of the basic right to have gainful employment, “To deprive anyone of employment is to deprive them of sustenance. Employment discrimination against gay men and lesbians is pervasive. The ACLU receives a flood of calls from men and women who have lost or been denied jobs, or failed to receive promotions, because of discrimination based on sexual orientation” (Anders 1). H. R. 311 being passed into law would also represent a victory against the Republican Party who has primarily been bought and paid for by the conservative right, including many religious leaders who still equate homosexuality with immoral depravity. Passing this Bill would send a message to those who cannot understand that homosexuality does not mean the basic rights of an individual should be limited or restricted in a country where equal protection of all rights through law is guaranteed. One only has to take a look at some of the comments of these types of leaders to see how their personal agenda and prejudices create a legitimizing environment
