The legality of full inclusion will be examined later; at this point, as a preface to later discussion, it is important to note that special education law stipulates that schools place students with disabilities in the least restrictive environment (LRE). The assumption behind the law as it pertains to LRE is that a variety of service delivery options need to be available. Public Law 94-142, the Education for All Handicapped Children Act of 1975, provides for a free public education for individuals with disabilities. Two of the law's provisions are particularly relevant to the inclusion issue. These provisions insure the existence of (1) individualized education programs (IEPs) in the (2) least restrictive environment (LRE). Special education reformers had worked hard to insure that a full range of educational services would, in fact, be offered. Previous to the passage of Public Law 94-142, school personnel were free to claim that they did not have services for children with disabilities and to deny these children access to regular classes.

Hallahan and Kauffman (1994) put the current debate over inclusion into perspective when they state, "in recent years, some special educators have begun to argue vehemently against the notion of the LRE. Although still a minority, this group is growing ever stronger and more vociferous in their attack on the LRE. These professionals believe in what they refer to as full inclusion" (p. 53). Susan and William Stainback (1992), of the University of Northern Iowa, are two such vocal proponents of full inclusion. They argue for no less than a need to "reconceptualize the construct of schooling [so that] the student is at the center of educational reform" (p. 5).
