Gun control has been a contentious issue in American politics for some time. Government regulation of guns has long affected the gun industry and has raised issues of how government action can add to costs without assuring greater safety. Recently, several cities have undertaken a new approach by suing gun manufacturers for the way their product is used, extending the idea of product liability in the same way earlier litigation did with the tobacco industry. The cities want the manufacturers to reimburse them for health care costs associated with shootings. This has generated considerable controversy. Those opposed to gun regulations are of course against this sort of litigation, but even many supporters of gun control find that this is the wrong method for achieving their ends and that such a substitution of the judicial power for legislative action creates more problems than it would solve and could lead to even more litigation against other products. The process is also expensive and adds to the cost of products for the consumer. The standard generally used to determine if an act or omission is negligent is that of the reasonable, prudent person in similar circumstances. This means that a negligent act exists when one does something that a reasonably prudent person should not do under the circumstances. A negligent omission exists when one fails to do something a reasonably prudent person should do under the circumstances (Alexander and Alexander 463464).
Business is subject to a wide variety of government regulations, and this includes the gun industry, which is regulated in terms of manufacture and selling of its products alike. Additional regulations add to the cost of the product and reduce the ability of the industry to survive, and while this may be necessary in certain circumstances, the kind of costs current efforts would add may not be justified because the outcome will not be that impressive. The costs of the kinds of lawsuits currently being directed at the industry also will only add to costs without solving the underlying problems, which in any case is based on questionable legal arguments.
