INTERNATIONAL LEGAL AND ETHICAL ISSUES SIMULATIONThe problems addressed in the simulation concerned international contractual arrangements between CadMex Pharma, a firm based in the United States, and Gentura, a firm based in Candore. The issues were assessed and decisions made from legal perspectives; however, the potential outcomes of decisions were evaluated within the contexts of political, business, and ethical frames of reference. Decisions Related to Choice-in-Law Clause and Dispute Resolution Forum Clause The decision related to the choice-in-law clause was for the Candorean Regulations for Technology Import Contracts. The reasoning for selecting this option was that Candore was not at the time a signatory to any international trading agreements. Thus, working within the legal system wherein any contract breach likely would occur appeared to be in the best interest of CadMex Pharma. This decision was not completely comfortable for each of the three executives who provided opinions. Conversely, however, the option was supported by some, while not being rejected out-of-hand by any. The decision related to the dispute resolution forum clause was for the International Arbitration option. Within the International Arbitration option, the decision was for Binding Arbitration.
