Harassment in the Workplace

In an article published in Restaurant Business (2004) revealed that the U.S. Equal Employment Opportunity Commission is suing Cracker Barrel and its parent for the alleged sexual and racial harassment of ten employees in three Illinois units of the restaurant chain. The EEOC alleges that the female workers had been subjected to sexual assaults, sexual propositions, obscene jokes, and the circulation of pornography. The suit also alleges that some of the African-Americans among the ten employees represented by the EEOC were subjected to racial discrimination and harassment including derogatory comments about the work habits of African-Americans in general and about the employees in particular.

The EEOC said it sued on behalf of the employees because Cracker Barrel's corporate management team had not responded to the employees' complaints. In response to the lawsuit, Cracker Barrel Restaurants indicates that it did an investigation with the help of outside counsel and did not find any truth to the allegations (2004). Because the company used legal counsel to conduct the investigation, attorney-client privilege will prevent the attorney hired
