An approach to criminal justice in such a tumultuous state as Argentina would lack efficacy if it were to neglect the profound political implications that have manipulated the application of law for generations.

In Argentina between 1930 and 1976 seven civilian-backed military coups took place; presidents were appointed by the army, elections were often fraudulent, and ideological conflicts were rife. Justice ôdelayed and deniedö became a recurring theme in Argentina; following World War II the admission of Nazi war criminals to the country set a curious and damaging precedent: a safe haven in exchange for money (Sax, 2003, p. 1). Over the coming decades, impunity would become something of a legal norm in Argentina. The stage was set for the perpetration of heinous crimes on a massive scale, and due to constantly shifting coalitions of power the criminal justice system was nascent or transitional for much of the time (Ocampo, 1999, p. 669).

Opposition from conservative sectors, the Radical Party, liberal groups and the Catholic Church coalesced in the 1950s, culminating with the ousting of then-president Juan Peron. By 1966 the presidency had been usurped by General Juan Carlos Ongania; guerrilla groups soon emerged, some of which had been financed or trained by communist Cuba (Ocampo, 1999, p. 669-671). During this phase in ArgentinaÆs history, military governments were vulnerable to the same brand of violence that had brought them to power. Violence, it seemed, had become a viable political tool, and as such, criminal activity such as kidnapping and murder had gained support within Argentine society. Socialist guerrilla factions targeted businesspersons and union leaders as surely as they did military personnel. By the mid 70s, ôguerrilla groups, union leaders, and anticommunist death squad...
