Aggravated Assault

The term "Aggravated Assault" figures prominently in debate and statistical analysis of crime in America and yet - though it is clearly defined by law - remains largely misunderstood by the public and politicians concerned with this aspect of criminology. Penal code (Salottolo, 1975, pp. 30 - 31, 43 - 45) and legal texts (Delsack, 1991, pp. 130 & 137) tend to agree upon the general descriptive outlines of Aggravated Assault, although the specifics - in terms of both case law precedent and placement within the penal code structure - vary according to locality. A third word, "Battery," is usually employed in connection with the term. For the purposes of further discussion in this paper, the terms "Assault," "Battery" and "Aggravated Assault" shall utilize the following definitions:

Assault - a threat to do bodily harm by someone whose ability to carry out the threat is such that the victim fears he or she is in imminent danger; the victim does not have to be physically touched to be assaulted (Dobelis, 1991, p. 70);

Battery - the execution or accomplishment of the assault; Battery is considered an intentional act (ibid., p. 71);

Aggravated Assault - a serious or dangerous attack, such as with a knife (ibid., p. 28).
