Unlicensed Assistive Personnel

The NCSBN is working on a position paper on the delegation of duties by nurses to unlicensed assistive personnel (Working, 2005). The Board of Nursing regulates nursing practice and State Nurse Practice Acts determine what level of licensed nurse is authorized to delegate. Delegation by a Registered Nurse (RN) requires making a clinical judgment and being accountable for client care. Nursing teaching should include the theory of delegation and opportunities for case studies with simulated exercises in delegation, but the application of delegation theory into practice occurs in a practical setting in which the nurse has gained the clinical experience which will allow her to make decisions about delegating duties and give her the authority to enforce such delegation.

Delegation involves both individual and organizational accountability (Working, 2005). The organizational accountability is dependent on what resources are available, the availability of an appropriate staff mix and adequate staff, the implementation of policies, role descriptions for staff, continuing staff development opportunities, and a working environment which encourages collaboration, teamwork, and client-centered care. Delegation means transferring authority to competent individuals to perform certain nursing tasks/activities and to direct someone to perform those tasks/activities within an authorized scope of practice. Duties of the nurse which cannot be delegated include assessment, evaluation, planning, and nursing judgment.

The delegation process requires assessment to be made of the client on whom the tasks/activities are to be performed, the staff to whom these duties are delegated, and the context in which the delegation is to take place (Working, 2005).
