1. Hyle v. Motor Vehicle AdministrationPolice pulled over Hyle because he was observed crossing the double yellow lines and running a red light. Hyle admitted having a couple of drinks. Hyle was given a number of field sobriety tests, and after failing one of the tests, was arrested on suspicion of drunk driving. At the police station he refused to sign a DR-15 Advice of Rights form advising him his license could be suspended if he failed a test for alcohol or if he refused to take a test. Hyle agreed to take a breath test. However, no technician was available to administer the test, so Hyle was informed he would be transported to Mercy Hospital for a blood test, which he refused. As a consequence of this refusal, his license was suspended for 120 days as provided for in #16-205.1(b)(1)(i)2.A. Hyle requested an administrative hearing regarding the proposed suspension. Hyle then appealed to the Circuit Court of Worcester County. Hyle then petitioned the Court of Appeals for Maryland for a writ of certiorari. Administrative hearing upheld the suspension.
