University Research

Research at universities is becoming a complex issue on many fronts because of the variety of sources of funding, both governmental and private, and the questions of ownership of the results of such research. Although medical issues have gained much of the public spotlight, where the question of the validity of test results on drugs has been questioned recently in light of the heavy involvement of the pharmaceutical industry in funding research, many other legal issues arise.

The National Institutes of Health have issued Regulations and Ethical Guidelines for all those doing research involving human subjects at their own research facilities which can serve as a model for university researchers everywhere (National). The passage of the Health Insurance Portability and Accountability Act (HIPPA) in 1996, and the publication in December, 2000 of the Department of Health and Human Services rule called the Standards for Privacy of Individually Identifiable Health Information, which became effective in April of 2001, go a long way to ensuring patient privacy in terms of the information gathered in research studies conducted at universities and elsewhere.

There still remain a lot of gray areas in terms of who owns what in regard to research done by graduate students and employees of university research departments. Individual universities set up guidelines for their own establishments, but few are complete and wide ranging enough to cover all scenarios. For instance, the University of California San Diego has a well-defined set of guidelines for the relationships between students, faculty, and industry as far as research is concerned, and as to who has ownership of what (Research).
