State & Federal Employment Laws

There are several differences in state and federal systems of government in regard to employment laws. For instance, with the minimum wage law, the federal minimum wage is $5.15 per hour under provisions contained in the Fair Labor Standards Act (FLSA) (Federal, 2005). Non-exempt employees paid on an hourly basis must receive at least the federal minimum wage for every hour worked. When non-exempt employees paid in other ways such as salaries, commissions or on a piece-rate basis, must be paid the equivalent of at least the federal minimum wage when dividdd by the total hours worked in a workweek.

Many states also have minimum wage laws and these may differ from the federal minimum wage laws (Federal, 2005). When an employee is subject to both the federal and state minimum wage laws, he must be paid the higher of the two minimum wages. State minimum wage laws are usually not complicated, but they change frequently, depending on legislative activity. In some, the minimum wage increase applies to specific industries, such as in California, where at one point only computer software employees were affected. It is mandatory to post both federal and state minimum wage requirements.

An employment protection that is provided by the state of California system which is not provided by the federal system is the extension of protections and benefits of marriage to persons registered as domestic partners in California on and after January 1, 2005 (Legislative, 2003). The bill, known as the California Domestic Partner Rights and Responsibilities Act of 2003 makes a number of changes to the laws relating to domestic partners, including laws relating to financial support, legal claims and government regulated benefits for domestic partners.
