Government of Spain & the United States

Language, culture and society are three factors that influence the way a person thinks and a nation functions. Government administration and politics are societal factors that contribute to that function. Sometimes two distinctly different countries will act in a similar manner, and other times they will operate in entirely different ways. This paper will compare and contrast the constitution and government administration of the Kingdom of Spain (Spain) to that of the United States of America (United States).

Whereas the current United States Constitution was effective as of March 4, 1789, the constitution of the Kingdom of Spain has been effective only since December 29, 1978, making it a difference of 200 years between the two countries as to when they began using constitutional law. Both constitutions generally seem to outline a nation where citizen rights are honored and responsibilities laid out. The Spanish Constitution's Preamble says that it wants to "establish justice, liberty and security. . .and guarantee democratic coexistence: (The Spanish Constitution http://www.spainemb.org/information/constitucionin.htm). The United States Constitution's Preamble is slightly different in that it aspires to "form a more perfect Union," however it also wants to establish justice, liberty and security as a basis for a governing order (The United States Constitution http://www.house.gov/Constitution/Constitution.html).

One of the differences, however, is that while the United States set up a constitution-based federal republic with an elected head of state, the Spanish Constitution set up a parliamentary monarchy where the head of state is a hereditary post and the head of the government comes from the leading political party. Both these constitutions have universal suffrage, allowing for any registered citizen who is at least 18 years old the right to vote (The World Factbook, 2003).
