Prevention of Authorized Use. This approach, taken by roughly a quarter of the states with computer crime statutes, condemns activity which would deprive authorized parties of the full use of their computer facilities.

Unlawful Insertion. Some states prohibit any unauthorized addition of material into a computerized environment.

Voyeurism. Several states criminalize unauthorized access to a computer system for the purposes of simply examining its contents.

One of the biggest problems with computer crime statutes traditionally has been definitions. Language is everything when it comes to law, as anyone who listened to the President speak during the Lewinsky scandal surely learned. Thus, the problem of defining legislative terminology that encompasses potential loopholes when it comes to computer crime statutes is not an easy task. Definitions regarding access, intent and jurisdiction all play a role in defense against computer crime charges. Many critics of computer crime legislation complain that the mentality behind knowingly and intentionally intent standards is the wrong mindset for prosecuting computer crimes. For example, a programmer who has released a virus that has done harm to other computer users may claim that the virus’s release was accidental and no harm was intended. However, in U.S. v. Morris, the defendant argued that he did not intend to create a harmful virus. Morris’ attorney argued that his control over the virus ended once it had been released. However, the selective reading of the federal statute by the appeals court shows the significance in definitions when it comes to computer crime statutes, “Perhaps in an effort to eliminate this problem, the appeals court did not read the intent aspect of 1030 (a)(5) to address the question of what Morris intended his worm to do once he released it.
