He believes that the effects of past discrimination still affect the Asian American community today. ôNot all high schools are the same, not all communities are the same, and not all Asian-Americans are the same,ö he says. ôI know how it is to be stuck on the bottom of the ladder and not be given a boost.ö His roommate, however, disagrees. Jonathan Hsieh is the Chinese American son of an accountant and a homemaker, who grew up in affluent San Marino, California. Hsieh believes that college admissions should be based on merit alone. But the argument over ômeritö highlights the heart of the affirmative action debate.

Critics of affirmative action charge that taking race and ethnic heritage into account compromises this countryÆs idealistic commitment to rewarding individuals for hard work and success. But four law professors who authored a policy analysis in favor of affirmative action programs for Asian American students contend that this argument is too simplistic, particularly as it relates to Asian Americans. In particular, Chin et. al. argue that affirmative action supposedly compromises merit because it admits students of color based on factors other than grade point average (GPA) and standardized test scores. But the authors point out that schools weigh GPAs and test scores according to comparison scales for the preparatory institution the student attended and the course work the student took while there. Chin et. al. argue that Asian Americans can easily be disadvantaged by the manipulation of these seemingly neutral factors if, for example, the admitting schools gave greater weight to the verbal portion of the SAT exam or no credit for non-European foreign language skills. The authors argue that since universities have historically done exactly this to Asian Americans, one should be skeptical about claims that academic merit is a scientifically measurable characteristic that can be gauged objectively. ...
