Those individuals who contend that term limits on congressional members may be imposed at the statelevel of government base those contention on the Tenth Amendment to the Constitution that states that "powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people" (Constitution, Amendments, Article X). Countering this contention, however, is the fact that the Constitution does establish specific criteria for election to the United States Senate and the United States House of Representatives. As such criteria are clearly stated in the Constitution, the counter argument is that such statement of criteria constitutes a delegation of power to the United States to establish qualifications for the election of members of Congress.

A troubling aspect of the term limits issue is that the great majority of the people who favor term limitations for members of Congress are not even aware of the constitutional nuances of the issue. These people simply think that term limits is
