They help inform and explain their actions, but are not directly relevant to an analysis or evaluation of their respective legal positions. The most relevant facts have to do with the efforts by Union organizers to obtain the signatures of employees on Union membership cards and to persuade employees to support the Union organizing effort and the actions taken by Bank management to counter the Union's actions.
