Many traditional statutes may be applied to criminal activity involving computers. These traditional statutes concern such actions as arson, criminal mischief, burglary, larceny, theft of trade secrets, embezzlement, receipt of stolen property, theft of services under false pretenses, forgery, and conspiracy (Sloan, 1984). Unfortunately, these traditional statutes are often wanting when it comes to the control of computer crime. Congress passed the first law dealing specifically with computer crime in 1985. Under this law, first-time offenders could be jailed for up to 10-years, or fined up to double their gain or $10,000, whichever is greater (Reilly, 1984). This law is applicable when the gains of computer crime exceed $5,000.
