The Education for All Act requires claimants to pursue all available state and local administrative procedures first. Federal regulations allow local agencies 45 days in which to determine a child's placement in public school. State agencies then have 30 or more days to evaluate the decision of local school officials. Hearing and reviewing extensions may be granted at the request of either party. This long procedure may cause children to lose up to two months of school.

Both the National Education Association and the Center for Disease,Control recommend that children with AIDS only be excluded from school if they are likely to infect others. Children who cannot control their own bodily excretions would fall within this category.
