Historically, the rule of law has not been emphasized in China, and the country did not even begin a codification of its legal system until the earlytwentieth century.3 Problems remain in contemporary China, with respect to an acceptance by the Chinese people of the socalled rule of law. Traditionally, the Chinese have believed that the correct way to effect behavioral changes was through a process of education coupled with an inculcation in the individual of societal values. The Chinese philosophy has been traditionally that law is unnecessary to regulate Chinese society and the internal commerce of the nation.

With the fall of the imperial government in 1912, civil and criminal laws were developed in China. Unfortunately, from 1912 through 1949, China was torn by divisive civil wars, invaded by foreign countries, and was drawn into the Second World War as a participant. The turbulent environment insured that the new system of laws was not effectively implemented.
