Act (12 U.S.C. 175 et seq.), and the Farm Credit Act of 1971 (12 U.S.C. 2001 et seq.). The Act is related to others laws that are listed and which the Act does not affect any provisions of: Communications Act of 1934 (47 U.S.C. S.222, S.663, S.551), the Children’s Online Privacy Act of 1998, the Gramm-Leach-Bliley Act, or the Health Insurance Portability and Accountability Act of 1996.

Civil penalties are imposed for violations of S.2(a) of the Act, with a civil penalty of $22,000 for each violation. For each day that a violation continues it will be considered a separate punishable offense and the maximum penalty for such violations is not to exceed a total of $500,000. The language on what constitutes user notice is extensive and includes eight categories (S.2(b)(1)(A-H)) that mandate such notice is provided by commercial Web site operators. Such categories define when notice must be given as well as the content of such notices for each category of user information use.
