The most recent round in this battle went to Intel when a California state appeals court overturned the decision of an arbitrator that gave AMD the technology rights to arch rival Intel Corporation's 386 microprocessor. This opens the way for Intel to proceed with a copyright-infringement claim against AMD over AMD's use of Intel software, known as microcode, in its clones of Intel 386 chips. If Intel can prove in court that AMD does not have the right to use its microcode, the company could the seek to recover any profit it claims to have lost as a result of AMD's entry into the 386 market (Weber, 1993, D1).
