Issue #2: Public Funding of Private Schools

Still another concern in education law concerns private schools. According to La Morte (1998), while parents have a fundamental right to direct the education of their children by sending them to private schools, if they so choose, the United States Constitution does provide for some restrictions on governmental funding available to private schools. However, the exact parameters of this restriction are murky and consequently there have been numerous Supreme Court cases seeking to delineate the bounds of what is and is not constitutionally permitted public funding.
