(1) the time and labor required, the novelty and difficulty

of the questions involved, and the skill requisite to

perform the legal service properly;

(2) the likelihood, if apparent to the client, that the

acceptance of the particular employment will preclude other

(3) the fee customarily charged in the locality for similar

(4) the amount involved and the results obtained;

(5) the time limitations imposed by the client or by the

(6) the nature and length of the professional relationship

(7) the experience, reputation, and ability of the lawyer

or lawyers performing the services; and

(8) whether the fee is fixed or contingent.

Attorneys are also obligated to act in a timely fashion in responding to the needs and concerns of their clients. Defining what is meant by "timely fashion:" may be difficult, but in general this is understood to mean that a lawyer will take up, address and resolve to the degree possible all client issues in a manner that does not deny the client full access to all rights received under the law and which does not result in damage or loss to the client.

Attorneys are, however, charged with refraining from soliciting professional employment from prospective clients by written, recorded, or electronic communication or by in-person, telephone, or real time electronic contact if the prospective client does not want to be solicited. In other words, the attorney may not use his or her expertise or powers of persuasion to coerce or otherwise induce an individual who has on interest is legal services to obtain and then pay for those services. The American Bar Association is quite specific as to what types of advertising may be conducted. Under Rule 7.2, Advertising, the ABA has stated that a lawyer is not allowed to give anything of value to a person for recommending a lawyer's service.
