Once the clause has been included in the contract, there is strong reason for upholding its validity later on. Since both parties have agreed in principle to the contents of the contract (and thus to the clause itself), challenging the validity of the clause later can cause a loss of faith in the overall contract and the validity of other clauses. Contracts are signed and fulfilled on the basis of their validity, and challenging those clauses which are later determined to be disadvantageous to a company may cause problems for that organization later on as other companies may be reluctant to enter into trade agreements. However, contracts or clauses which are clearly being violated should be challenged.
