The confrontational and unapologetic activities of Microsoft at trial have affected the debate about whether Microsoft acted unlawfully. For example, the original trial judge, Thomas Penfield Jackson, was so dismayed by the actions and attitude of Microsoft, its attorney and its executives that he began giving interviews to accredited members of the press while the trial was in progress. During at least one of these interviews, Judge Jackson suggested that Microsoft executives acted more like modern day Mafia gangsters than as businessmen.

When Judge Jackson's comments were made public, Microsoft appealed his verdict against Microsoft which ordered the company to be split in two. In its appeal, Microsoft alleged that:

The fair thing to do would be for he Appeals court to set aside the verdict of the lower court.
