Teak, whose business in part was the reselling of used furniture, asked Mr. Cyrus how much he wanted for the chairs. Mr. Cyrus who had entered merchant Teak=s store unbidden replied to A. Teak A What will you give me for them?@. Merchant Teak recognized the value of the chairs and offered a total of $100, which Mr. Cyrus excepted. Merchant Teak was aware that the retail value of these chairs was quite a bit higher than what he had paid Mr. Cyrus.

The following day Mr. Cyrus returned with a box full of assorted small items and merchant Teak offered Mr. Cyrus a total of $50 for the lot, which Mr. Cyrus excepted. At this point Mr. Cyrus volunteered that he had a whole house full of furniture and items that he had inherited from...
