Labor Arbitration

ss the extent to which the biases or personal views of labor arbitrators may (or may not) influence the outcomes of cases involving drug and alcohol use in the workplace. The thesis to be explored herein is that while very specific strictures against bias exist, backed by procedural safeguards to reduce the potential for bias effects in arbitrator decision-making, some bias invariably enters into decision-making. Issues to be explored include: 1) standards of arbitrator performance, with specific reference to bias; 2) the type and incidence of arbitration cases involving drug and/or alcohol; and, 3) the observation of bias, and the resolutions offered to this problem.
