Use of Intermediate Sanctions

lysis of the application of intermediate sanctions in the administration of criminal justice considers four elements of the process of implementing the policy and two outcome measures of the effectiveness of the policy. These process elements and outcome measures of effectiveness are as follows:

a. The first process element is the role of the judiciary in the implementation of an intermediate sanctions policy.

b. The second process element is the procedure used in the identification of intermediate sanction alternative appropriate for a specific case or class of cases.

c. The third process element is availability and quality of data for use in the targeting of specific offenders or offender classes for the application of an intermediate sanctions policy.

d. The fourth process element is the procedure used in the targeting and identification of specific offenders for the application of an intermediate sanctions policy.

2. Outcome measures of effectiveness:

a. The first outcome measure of the effectiveness of an intermediate sanctions policy is the recidivism rate of offenders diverted to an intermediate sanctions program in comparison with recidivism rates for incarceration in prison, probation, or some other form of intermediate sanctions. This evaluation criterion is consistent with the requirements for policy analysis described by Patton and Sawicki (1993).
