As an example, President Bush, just prior to the initiation of hostile activities against Iraq in January 1991, excused the Department of Defense from the need to observe environmental protection laws and regulations for the duration of the conflict. Thus, it is proposed that a research study be conducted, which will investigate the following questions:
1. Does the process by which environmental protection laws and regulations are applied to the activities of the Department of Defense lead to a slackness in the application of such laws and regulations which would not be tolerated in an application to a private sector activity?
2. Does the process by which environmental protection laws and regulations are applied to the activities of the Department of Defense provide for adequate accountability to the Congress and to the American public on the part of Department of Defense public administrators?
The significance of environmental protection is well accepted. If the loophole of national security is being used to undermine the national will concerning environmental protection, a serious miscarriage of justice is being perpetrated on the entire nation.
