The problem occurred when the hospital mistakenly fertilized Mrs. A's egg with Mr. B's sperm, the result of which was the birth of the twins YA and ZA. Notably, Mr. B had only authorized the hospital to inseminate his own wife, Mrs. B., with his sperm.

In The L Teaching Hospitals NHS Trust, the court, therefore, had to weigh the rights of each adult involved in the case, as well as the children's best interests. In the end, it was the children's interests that ultimately laid the foundation for the court's decision. As the court noted, one of the most important principles to be found in the 1990 Act is the welfare of any children born by treatment covered by the Act. The court held that the children had a right to have their true biological parentage recognized by the courts rather than "hidden" under a legal presumption. Thus, the court found that the 1990 Act did not apply to make Mr. A the children's legal father. Rather, the court ultimately held that the Act required that Mr. B be recognized as the children's legal father while Mr. A could be granted legal parental responsibility for the children if he so petitioned.

The significance of The L Teaching Hospitals NHS Trust to Tony's case lies in the fact that the court in that case found that neither Mr. A nor Mr. B had consented to Mr. B's sperm being used to fertilized Mrs. A's eggs. In particular, because Mr. A had not consented to such fertilization, he could not be protected by the legal presumption that he was the father of Mrs. A's child. Nevertheless, the court did find that "Mr A is in the position of the father and has established a close relationship with the twins whom he regards as his children. His rights are therefore also clearly engaged." Mr. A, therefore, had the right to apply for legal recognition of his rights of parental responsibility....
