The passage of the Educational Amendments of 1972, signed into law by then President Richard M. Nixon, helped pave the way for leveling the playing field between males and females in intercollegiate athletics. Under Title IX of the Education Amendments of 1972 (20 U.S.C. 1681 et seq.), the law ôprohibits discrimination on the basis of sex in education programs receiving Federal financial assistanceö (Finding, 1997, p. 1). Under the regulation (34 C.F.R. Part 106)) responsible for the implementation of Title IX, there are provisions pertaining to athletic opportunities in the following areas: 1) student interests and abilities; 2) athletic benefits and opportunities; and, 3) financial assistance (Finding, 1997, p. 1). Despite Title IX being responsible for greater numbers of females participating in sports, Colleges and Universities are finding it difficult to acquire the financial resources to comply with implementation of Title IX requirements. The financing requirements of Title IX are based on proportionality. In other words, colleges and universities must provide athletic opportunities, including scholarships, to both makes and females in ôproportion to the participation rate of each sex in intercollegiate athleticsö (Finding, 1997, p. 4).
