In Horner v. Kentucky High School Athletic Association (2000), the issue of sexual harassment in athletics is at play. Under Title IX of the Educational Amendments Act, schools can be sued for monetary damages ôfor knowingly allowing sexual harassment to take place in any setting, including athletic onesö (Brady, 2004, 1). Sexual harassment involves unwanted sexual attention that may take a variety of forms, from sexual graffiti to practical jokes based on sex to more offensive actions such as intimidation based on sex or unwanted physical contact. In Horner v. Kentucky High School (2000), the plaintiffs allege that the Athletic Association failed to sanction is fast-pitch softball team after ongoing complaints of sexual harassment toward female players from male coaches and assistants.
