conduct of intercollegiate athletics shall be exercised by the institution itself and by the conferences, if any, of which it is a memberö (NCAA, 2006, p. 49). Baylor University was found in violation of this Bylaw during the infractions hearing. Bylaw 10.1, unethical conduct, provides five subsections (a-e) which constitute unethical conduct. Baylor University, in failing to report violations of the failed drug tests of three student athletes was found in violation of subsection (a), ôrefusal to furnish information relevant to an investigation of a possible violation of an NCAA regulation,ö and subsection (d), ôknowingly furnishing the NCAA or the individualÆs institution with false or misleading information concerning the individualÆs involvement in order knowledge of matters relevant to a possible violation of NCAA regulationsö (NCAA, 2006, p. 53).

Baylor University officials maintained that failure to comply with NCAA regulations regarding banned substances were the result of a number of factors. One of these was a depleted compliance staff. Another reason for failure to comply was that athleticsÆ officials held the ômistaken impression that the institution had remedied deficiencies in its system following previous infractions casesö (Marsh, 2005, p. 4). One of the biggest reasons for failure to comply with NCAA regulations, according to Baylor officials, was the ôgreat deferenceö paid to the head basketball coach whose long history showed a ôclean record and good reputationö (Marsh, 2005, p. 4).
