Legal Issues at Guantanamo Bay

as the terrorist attack on the United States on September 11, 2001 is the application of provisions of the Geneva Convention to prisoners of war, with prisoners of war consisting of non-state actors and their associates known or expected as being involved in the terrorist attack. Fundamental questions regarding whether or not the government of the United States and its allies were correct in detaining a number of non-state, non-military actors at a prison camp at Guantanamo Bay have been raised.

There are many allegations that the individuals detained at Guantanamo Bay were unjustly detained, detained without access to even the basic processes available under military law during times of war, and/or subjected to cruel and unusual punishment in terms of torture.
