In 1996, Congress passed by overwhelming majorities the Community Decency Act which contains two key provisions which pose First Amendment issues: (1) it is crime to send information over the Internet "on any drug, medicine, article or thing designed, adapted or intended for producing abortion." The Economist pointed out that since the Supreme Court in Roe v. Wade decided that a woman under certain circumstances had a constitutional right to elect to have an abortion, surely it is violation of the right of free speech to proscribe talk about abortion on the Internet; and (2) criminal penalties including a fine of up to $250,000 ($500,000 for corp[oration) and a prison term of up to two years are imposed on anyone who allows and fails to 'make good faith efforts' to remove the transmission, posting or distribution of indecent material on the Internet to persons over the age of 18. Indecent material is defined as "any communication that in context, depicts or describes, in terms patently offensive, as measured by contemporary community standards, sexual or excretory activities or organs."

Enforcement of the Community Decency Act has been stayed under a temporary restraining order issued by a federal district judge in early 1996 and has subsequently been affirmed by a three judge appellate panel there. The Supreme Court is expected to rule soon on the constitutionality of the Act.

During the early 90s, the movement to limit the terms of members of Congress and other elected officials at all levels of government crested and may be declining.
