Types of Crimes: Review of the Literature Related to the Nature of Crime

Reid (2007) make the point that if one is to fully understand the nature of crime, there needs to also be some examination of who makes the laws and whether they represent the views of society in general or simply the views of the privileged class that is more interested in losing its class-based benefits than in protecting the general public. In such cases, it could be argued that the law specifying various actions as criminal is itself flawed and without merit and therefore any one convicted under the law should be viewed as innocent. According to Reid, the practice of Clarence Darrow often focused on this notion in his work for the American Civil Liberties Union.

The nature of crime is also understood by examining its categories and distinctions. Rush (2004) notes that there are various ways that crimes are distinguished. Typically, researchers and scholars tend to view crimes as actions that offend or are in some way against society; they will then categorize the crimes according to the particular nature of the offense, e.g., a crime against the public order, or against the personality of the State, or against the public faith. Scholars and researchers will also sometimes distinguish crimes based on differences in degree of punishment associated with the offense.

The penal system tends to divide crime into specific types, e.g., types of property crime, and types of crimes committed against people. Rush (2004) states that once crimes are divided into property or people crimes, they are often then further subdivided by various other properties and punishments. For example, they can be divided by differences in severity, and or whether they are misdemeanors or felonies. Despite these subdivisions, the two distinctions most often used to distinguish crime are crimes against property and crimes against people. These are both examined in this paper.
