he availability of the exemption depends on the actual work activities performed, and not on the job title or the nature of the employer's business of the amount of money an employee is paid hourly or annually. Exemption is based on primary duties which relates to what work an employee performs 50 percent or more of the work time. Under the FLSA, an exemption can be lost if an employee devotes too much time to non exempt duties. Also, while it is not necessary to pay exempt employees for workweeks in which they perform no work, but otherwise their salary cannot be reduced based on the number of hours worked or based on the number of hours of absence (Shilling, 1998)
