ow sometimes call barbarians. But simply because a practice is an ancient one does not mean that it holds no value for contemporary society, and the fact that vengeance has for so long been at the core of ideas about criminality and justice should underscore its importance to human society.

Humans in a given society or culture may well determine that certain categories of behaviors are so terrible that they must be met with death, even if such punishments have no deterrent value. That is the argument made here, with the amendment that the death penalty should be administered in a more fair and just way than is now the case in the United States.

Wedded to this ancient idea that ôthe punishment should fit the crimeö are more complex arguments developed relatively recently. These arguments are complex in part because they refer to an area of complicated human motivation and behavior. They also reflect the intricate and sometimes even conflicting ideas theorists have about the nature of justice and the ways that crime is produced in our society, for certainly all intelligent criminal justice theorists must feel both compassion as well as horror at the extreme form of social deviance known as crime.
