In assessing the constitutionality of the K 12 funding system in Illinois, the author considers the experiences of other states as well as those of Illinois. The work begins with a review of the history in the United States of litigation over state aid to education up until the time that the first successful challenge to a state's educational funding system occurred in California. The work then analyzes the Serrano vs. Priest decision that successfully challenged the California system, and the Rodriguez vs. San Antonio Independent School District decision that was rendered in relation to the system of school finance in Texas. Other state and federal court decisions (including one by the United States Supreme Court) are reviewed as a part of the assessment of the constitutionality of school financing in Illinois.
