The study guide is divided into the same 11 parts as the main text, and each chapter is given brief review. The first part of the book, "Legal Rights and Social Forces," provides the reader with an overview of law in society. This three-chapter section examines law and law enforcement agencies, law as an expression of social forces, and crimes and torts. In Chapter 1, Anderson, Fox and Twomey suggest that law consists of principles of conduct which are constantly evolving and which can be enforced by courts. Constitutional law (both state and national), statutory law and administrative regulations are all cited as examples of type of law. Basing a ruling on court precedent is known as stare decisis. The authors then move to specific types of law, such as substantive and procedural. Substantive defines rights and liabilities while procedural law specifies the steps to be followed in enforcing those rights and liabilities. Jurisdiction refers to the power and right of a particular court to decide a specific controversy, and the Supreme Court is identified as the highest federal court. Criminal courts hear offenses against the public while civil courts hear matters involving private rights. Arbitration, which is legally binding, can be used in place of courts in private cases. There are no cases in this largely introductory chapter.
